Terms of Use for Cephalo

1. Acceptance of Terms

By downloading, installing, or using Cephalo ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Cephalo is a personal health tracking application designed to help users log and monitor headache episodes. The App provides tools for:

  • Recording headache episodes and symptoms
  • Tracking patterns and triggers
  • Generating reports for healthcare providers
  • Optional integration with Apple Health
  • Optional iCloud synchronization

3. Medical Disclaimer

IMPORTANT: Cephalo is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or health condition.

  • The App is for informational and tracking purposes only
  • Always consult qualified healthcare professionals for medical advice
  • Never delay seeking medical attention based on information from the App
  • In case of medical emergency, contact emergency services immediately

4. User Responsibilities

You agree to:

  • Provide accurate information when using the App
  • Use the App only for lawful purposes
  • Maintain the confidentiality of your data
  • Not attempt to reverse engineer or compromise the App
  • Not use the App for any commercial purposes without permission

5. Privacy and Data

5.1 Data Storage

  • Your health data is stored locally on your device by default
  • Optional iCloud sync stores data in your personal iCloud account
  • We do not have access to your health data

5.2 Data Control

  • You maintain full control over your data
  • You can export or delete your data at any time
  • Deleting the App will remove all local data

5.3 Third-Party Services

  • Apple Health integration is optional and governed by Apple's terms
  • iCloud sync is optional and governed by Apple's iCloud terms

6. Intellectual Property

  • The App and its original content, features, and functionality are owned by Iterica B.V.
  • The App is protected by international copyright and trademark laws
  • You may not copy, modify, or distribute the App without permission

7. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The App is provided "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • We are not liable for any loss of data or interruption of service
  • Our total liability shall not exceed the amount paid for the App

8. Indemnification

You agree to indemnify and hold harmless Iterica B.V. and the App developer from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App or on our website. Continued use of the App after changes constitutes acceptance of the modified Terms.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for any reason, including breach of these Terms.

11. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Netherlands.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Apple-Specific Terms

If you download the App from the Apple App Store:

  • These Terms are between you and Iterica B.V., not Apple
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product liability claims
  • Apple is not responsible for addressing claims of intellectual property infringement
  • Apple is a third-party beneficiary of these Terms with the right to enforce them

15. Entire Agreement

These Terms constitute the entire agreement between you and Iterica B.V. regarding the App and supersede all prior agreements and understandings.

By using Cephalo, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
